Părțile și obiectul contractului de autor

Abstract

Autorul articolului examinează statutul juridic al părților contractului de autor, delimitează calitatea de autor al operei de cea a titularului dreptului de autor, analizează valabilitatea contractului prin prisma capacității de exercițiu a părților și a consimțământului manifestat de aceștia la încheierea actului juridic. De asemenea, autorul precizează obiectul contractului de autor din perspectiva legislației în vigoare și a literaturii de specialitate și analizează condițiile impuse de legislația civilă în privința obiectului contractului de autor. Astfel, contractul de autor trebuie să existe, să fie determinat sau determinabil, să fie posibil, să fie legal și să fie în circuitul civil.
