Hititlerde Tarımsal Üretimde Bazı Suçlara Karşı Yaptırımların İncelenmesi ve Türk Hukukuyla Karşılaştırılması

Abstract

M.Ö. 2000’li yıllarda, Anadolu’nun önemli kültürlerinden olan Hitit ekonomisi tarım ve hayvancılığa dayanmaktaydı. Bu çalışmada, Hitit uygarlığının tarımsal üretimde sürdürülebilirliği nasıl sağladığı, tarım hukuku ile ilgili bazı yaptırımlar, mevsimlik işçilerde ücret ve tarımsal üretimde karşılaşılan bazı problemlerin incelenmesi amaçlanmıştır. Bu amaca ulaşmak için, transkribe edilmiş, başlıca Hitit yasalarından faydalanılmıştır. Hititler döneminde tarım ürünleri başta buğday ve arpa olmak üzere birçok sebze ve meyvelerden oluşmaktaydı. Tarımsal üretimde iklimsel, coğrafi, düşman saldırısı ve çekirge zararlıları gibi sorunlarla karşılaşılmıştır. Genel olarak zirai üretimin yapıldığı işletmeler devlet denetiminde faaliyet gösteren çiftliklerdir. Bu çiftliklerde yapılan üretim, aile bireyleri, ‘NAM.RA’lar (devletin çiftliklere ücretsiz olarak dağıttığı köle/sivil tutsak) ve mevsimlik işçilerle yürütülmekteydi. Hititler, tarımsal üretimde sürdürülebilirliği sağlamak için hukuki düzenlemeler yapmıştır. Bu düzenlemelerde, hayvan ve tarımsal araç gereçlerin alım satımı, arazilerin işletilmesi ve/veya kiraya verilmesi gibi konulara yer verilmiştir. Bunlara ilave olarak, ekim alanlarının ateşe verilmesi, ekinlerin çalınması, meyve ağaçlarına el konulması ve arazi sınır ihlalleri gibi suçlara karşı yaptırımlar da yasal güvence altına alınmıştı.
