Tercihli Ticaret Anlaşmalarında Menşe Kuralının Önemi

Abstract

Menşe bir eşyanın ekonomik milliyeti olarak tanımlanmaktadır. Eşyanın menşeinin ne olduğu o eşyaya uygulanacak tarife veya tarife dışı engellerin belirlenmesi açısından önemlidir. Eşyaya uygulanan işlem veya işçiliğin tamamının bir ülkede gerçekleşmesi durumunda menşei belirlemek ülkeler açısından sorun teşkil etmezken eşyaya uygulanan işlem veya işçiliğin birden fazla ülkede gerçekleşmesi durumunda eşyanın hangi ülke menşeli olacağı menşe kuralları ile belirlenmektedir. Menşe kuralları kapsamında esaslı dönüşüm kriterleri; tarife kuralı, katma değer kuralı, iki aşamalı dönüşüm kuralı ve teknik analiz kuralı olarak sınıflandırılmaktadır. Menşe kurallarının hangi kriterle hangi eşyayı kapsayacağı ülkeler arasında imzalanan tercihli ticaret anlaşmaları ile belirlenmektedir. Menşe kurallarının ülkeler arasındaki menşe kuralları bazı durumlarda ticaret artırıcı etki yaratırken bazı durumlarda ise korumacı bir ticaret politikasına dönüşebilmektedir. Bu çalışma menşe kurallarının ortaya çıkışının tarihsel sürecini, menşe kurallarının neler olduğunu ve tercihli ticaret anlaşmaları kapsamında menşe kurallarının önemi ve üzerinde durulması gereken hususları incelemektedir.
