Yerel Çevre Politikaları ve Çevre Hakkı: Hatay İl Mahalli Çevre Kurulu Kararları Üzerine Bir Değerlendirme

Abstract

Ülkemizi yakın ve uzak gelecekte etkileyecek en önemli sorun alanlarından biri olarak çevre ve çevre sorunları önemli bir gündem maddesidir. Gerek merkezi yönetim, gerekse merkezi yönetimin taşra uzantıları ve yerel yönetimler, çevre sorunlarına yönelik çözüm bekleyen ciddi sorunlarla karşı karşıyadır. Başta 1982 Anayasası olmak üzere, çevre yasası ve diğer pek çok yasal düzenleme, kamu yönetiminde karar vericiler için çevre ile ilgili sorunlara yaklaşım biçimlerinin de sınırlarını çizmektedir. Çok aktörlü yönetişim olanakları, bu yasal çerçeve üzerinden yerel yönetimler başta olmak üzere, merkezin taşra uzantılarına, yerelde çevre sorunlarına yönelik karar alırken yeni fırsatlar sunmaktadır. İl Çevre Kurulları, hem yapıları ve işleyişleri açısından hem de aldıkları kararlar açısından İl yönetimleri için önemli bir fırsattır. Bu çalışmada İl Çere Kurullarının yasal statüleri, yapıları ve işleyişleri konu edilmekle beraber, özelde bu kurulların kararları ve bu kararların etkinliği sorgulanmaktadır. Çalışmanın uygulama alanı Hatay İl Çevre Kurulu ve bu kurulun son 2010-2016 yılları arasında almış olduğu kararlarının çözümlenmesine bu kararların yereldeki etkisine dayanmaktadır. Söz konusu kurulların yeniden ele alınıp, yapılandırılmalarıyla yerelde sadece çevre sorunlarının çözümüne yönelik değil, çevre ile ilgili yerel çevre politikalarının geliştirilmesinde ilgili bütün tarafların karar süreçlerinde etkin bir rol oynamalarını sağlayacaktır. Yerel çevre politikalarının oluşumu ve sorunlara yerinde çözüm üretmek anlamında İl Çevre Kurullarının yeri ve önemi her geçen gün artacaktır.
