El debate del impuesto sobre sucesiones y sus consecuencias en las explotaciones agrarias

Abstract

En primer lugar se explica la estructura y funcionamiento del ISD y sus antecedentes históricos, para pasar a continuación a describir la situación en la que el mismo se aplica en lo relativo a las explotaciones agrarias. Se describen las implicaciones recaudatorias que supondrían la supresión del impuesto y se buscan las razones económicas, y fundamentalmente jurídicas, en que se basa su desaparición en las herencias directas. Los fundamentos jurídicos se refieren tanto al derecho positivo, es decir la Constitución Española y las demás leyes incluido el derecho comparado, como a la interpretación que ha efectuado el Tribunal Constitucional. El trabajo se concluye en favor de la desaparición del ISD en las herencias directas, fundamentalmente en la transmisión hereditaria de las explotaciones agrarias...The objective of the work is to complete the required elimination of ISD for direct inheritance, with reference to hereditary transmission of farming activities. In the first instance, the structure and operability of ISD will be explained as well as its background followed by a description on the how ISD is applied to farming. Tax payment implications are described that entail tax suppression and economic and, more importantly, legal reasons are explored to base its elimination from direct inheritance. The legal basis refers to Substantive Law, rather the Spanish Constitution, as well as other laws including Comparative Law and interpretation made by the Constitutional Court.
