La aplicación en la Sierra soriana del derecho de posesión mesteño a los agostaderos durante el siglo XVII

Abstract

En este trabajo se trata de contribuir al conocimiento de los mecanismos que regulaban durante el Antiguo Régimen el mercado de pastos en las comarcas del reino de Castilla donde se concentraban en los meses de verano los ganados trashumantes. Para ello se ha escogido la comarca soriana, que presenta como peculiaridad frente a otras el que apenas se dio entrada en ella a ganaderos foráneos, por lo que fueron preferentemente ganaderos autóctonos los que se disputaron el aprovechamiento de pastos de verano. Y por esta misma razón el mercado de pastos no alcanzó allí gran desarrollo, dado que prevaleció el régimen de libre acceso para todos los vecinos. Se identifican, no obstante, en este trabajo los pastos a los que se accedió a través de arrendamientos. Y se trata de determinar en qué medida dicho mercado estuvo mediatizado por la aplicación del derecho de «posesión», que trataron de defender los ganaderos mesteños frente a los propietarios de los términos, que se resistieron a reconocerlo......In this article the author makes a contribution to the study of the patterns of regulation of the transactions for the renting of pastures in the kingdom of Castile during the Modern Age, especially in those regions where the trashumant sheep were concentrated in summer. He chooses for this study the region of Soria, where in contrast with other mountain regions of Castile, no foreign flockowners were admitted to exploit pastures, and as a result only resident flockowners disputed themselves the explotation of pastures in summer. In this region the free access to pastures for all the neighbours prevailed, and in consequence the hiring of pastures was much less usual than in other regions. Nevertheless, the author gives account of some sorts of pasture that were usually rented, and he tries to determine in which way the hiring transactions were affected by the application of the right of «posesión», that the flockowners who were members of the “Mesta” defended against the resistance of the lords of the lands that were rented.
