A nova lei do agro: o fundo garantidor solidário como alternativa às garantias do crédito rural

Abstract

: Public policies in Brazil play a fundamental role in the rural sector development. This article relates to the Fundo Garantidor Solidário (FGS), established by Law 13.986 of 2020, known as the New Agribusiness Law. Defended as an alternative to traditional guarantees of rural credit and as an inductor of new possibilities for private financing, the study aimed to investigate its elaboration process. It also sought to identify the actions of interest groups, the challenges for implementation and the prospect of adhering to this new form of guarantee by the target audience. For that, a literature review was carried out in order to verify existing studies on the subject, a documentary research, a manifestation in the Plataforma Integrada de Ouvidoria e Acesso à Informação do Governo Federal (Fala.BR) and data collection through semi-structured interviews. The results show that this public policy was perceived as unfeasible by the interviewees due to the requirements of fund composition, which requires financial contribution from the creditor, to the complex operational model and to the lack of information on the part of those who would be the beneficiaries, which led to its non-use and consequent amendment of the law two years later, in 2022.
