Spółdzielnie w rolnictwie w wybranych państwach Europy Zachodniej; aspekty prawne i ekonomiczne

The paper presents selected legal issues concerning cooperatives, including their organization and taxation. Additionally, it shows statistical data and indicates the directions of activities of cooperatives operating in agriculture and rural areas in selected countries of Western Europe, particularly in France, Germany and Denmark. The first two countries have a separate legislation concerning cooperatives, while in Denmark a unique Act on trading companies, common to all types of businesses entities, is in force. The information on regulation of cooperatives in foreign legal systems may be helpful in the process of creating both a new Cooperative Law and in the modernization of rural cooperative structures as well as in the process of determining the directions of their development in Poland. / Synopsis. Przedstawiono wybrane prawne zagadnienia dotyczące spółdzielni, w tym organizacji i kwestii podatkowych. Dodatkowo zaprezentowano dane statystyczne oraz wskazano kierunki działalności spółdzielni funkcjonujących w rolnictwie i na terenach wiejskich w wybranych krajach Europy Zachodniej, w szczególności we Francji, Niemczech i Danii. W pierwszych dwóch państwach istnieją odrębne ustawy dotyczące spółdzielczości, gdy tymczasem w Danii odnotować należy Akt o przedsiębiorstwach handlowych, wspólny dla wszystkich rodzajów podmiotów gospodarczych. Informacje na temat spółdzielni w tych systemach prawnych mogą być pomocne w procesie tworzenia zarówno nowej ustawy Prawo spółdzielcze, jak i przy modernizacji struktur spółdzielczości wiejskiej oraz określeniu kierunków jej rozwoju w Polsce.
