Umowa Dzierżawy Nieruchomości Rolnych Skarbu Państwa W Świetle Swobody Umów

Abstract

Omówiono sposoby zawierania umów na dzierżawę państwowych gruntów rolnych, która jest obecnie podstawową formą gospodarowania nieruchomościami wchodzącymi w skład Zasobu Własności Rolnej Skarbu Państwa. Wychodząc od zasady swobody umów przedstawiono okoliczności, które w oparciu o obowiązujące normy prawne powodują jej ograniczenie. Ponadto przedstawiono kluczowe elementy umowy z punktu widzenia interesu dzierżawcy. Rozważania prowadzą do wniosku o wyższym znaczeniu ochrony interesu publicznego niż trwałości gospodarowania na dzierżawionym gruncie przez dzierżawcę.
