Obligations of Banks in the Cheque Law No. 5941

Abstract

In this study, we aimed to point out the obligations of banks in the cheque law and introduce the legal and penal sanctions against them in case of the incompliance for these obligations. In this perspective, we informed general information commercial paper, commercial bill and cheque. Then we considered the deficiencies of the law no. 3167, the characteristics of the law no. 5941 about cheque operations and the aim of the modifications made in the law no. 6273. We presented the legal and penal sanctions against the banks in the new cheque law with pointing out the concerned clauses in both the former Turkish Commercial Law and the new Turkish Commercial Law no. 6102, comments in the doctrine, the decisions of the supreme court and the directives in the light of the main aim of the law and legislative intentions of related clauses. The penal and administrative provisions on the non-bank institutions and people outside the banks are excluded from the scope study.
