Fiqh Rules of Buying and Selling of Gold and Silver Jewelry أحكام بيع وشراء حلي الذهب والفضة

Abstract

In previous papas, the opinions of the majority of Muslim jurists regarding selling and buying of gold and silver jewelry have been highlighted. They have stipulated simultaneity (concurrence) and equality (equivalence). This paper, highlights the opinion of Ibn Taymiyyah and lbn Al-Qayyim, which is that jewelry trade permits time lapse (between sale of jewelry and receipt of price) and inequality (in case of exchanging jewelry for an amount of the same precious metal). Their opinion is based on the view that crafting of gold and silver into jewelry transforms these two metals from nba-related commodity-money into cormnon goodn This view assumes that the cause of restriction of”concurrence” and “equali’ as related in the Sunnal, is that gold and silver were money. After transformation into jewelry, they no longer are. The opinion of lbn Taymiyyah is a significant relief to goldsmiths and their customers, as trade in gold and silver jewelry becomes Wide in common goods, not subject to stringent riba-avoidance conditions. Besides highlighting this opinion the author has also stated the sources, introducing the scholars permitting non-equivalence in such transactions and those who allow lapse of time (deferment of the equivalent). في دراسات سابقة تم التركيز على آراء جمهور الأئمة والعلماء ، في مبادلات الحلي الذهبية والفضية ، حيث اشترطوا فيها التماثل والتعجيل . وفي هذه الدراسة يتم التركيز على رأي الإمامين ابن تيمية وابن القيم ، اللذين أجازا التفاضل والتأجيل . ووجه هذا الرأي أن الصناعة تنقل الذهب والفضة من مال ربوي إلى مال غير ربوي ، فإذا كانت علة الربا في الذهب والفضة الواردين في الحديث النبوي الشريف هي الثمنية ، فإنهما بالصناعة لم يعودا من الأثمان ( النقود) . وهذا الرأي فيه الكثير من التيسير على الصاغة والمتعاملين معهم ، إذ يصبح التعامل بهذه الحلي كالتعامل بالسلع العادية التي لا تخضع لأي قيود ربوية . لم يكتف الباحث ، في هذا البحث ، بإبراز هذه الرأي فحسب ، بل اهتم أيضاً ببيان أصوله ، من حيث التعريف بالعملاء الذين أجازوا التفاضل في هذا النوع من المبادلات ، والعلماء الذين أجازوا النساء ( تأجيل أو تأخير البدل) .
