Abstract
Delinquency in debt repayment by a solvent debtor is an especially serious problem in an Islamic Economy which clearly prohibits interest on debt. One recent juristic opinion suggested permitting monetary compensation by court order, to be imposed on the delinquent but solvent debtor to the benefit of the creditor. with compensation covering both any actual loss due to delinquency plus potential profits misted. That opinion was strongly challenged by other jurists. This paper critically surveys the different opinions and solutions offered for delinquency and suggests a new method of compensation that requires a delinquent but solvent debtor to repay the principal, and to extend to the creditor an interest-free loan that is equal in amount to the original principal and in duration to the period of delinquency. تتطلب الحياة الاقتصادية الناجعة قدرًا كبيرًا من عمليات المداينة بين الوحدات الاقتصادية. وتعد المماطلة في سداد الدين من قبل المدين الموسر (أي القادر على الوفاء) مشكلة خطيرة تهدد نظام المداينات وبخاصة في اقتصاد إسلامي يحرم الفوائد على الدين. وقد ظهر مؤخرًا رأي فقهي يقول: إن تعويض الدائن عن ضرره بسبب المماطلة يمكن أن يكون مبلغًا نقديًا فوق أصل الدين يحكم به القاضي ويغطي الضرر الفعلي والربح الفائت، وأنه يمكن تقييد هذا التعويض القضائي بقيود تميزه عن الربا المحرم. لكن هذا الرأي محل اعتراض شديد من فقهاء آخرين بسبب شبهة الربا في نظرهم. والبحث الحاضر يستعرض الآراء المطروحة ويقارن بينها، ثم يقدم أسلوبًا جديدًا للتعويض يتمثل في إلزام المدين قضائيًا بتقديم قرض حسن إجباري للدائن تحدد مدته ومقداره بحيث يكافئ الدين الأصلي ومدة المماطلة. ويناقش البحث بالتفصيل الأسس الشرعية والاقتصادية لأسلوب التعويض الجديد.
