Did the Contemporary Fuqaha' (Muslim Jurists) Fail to Clarify the Foundations of Islamic Economic System? هل قصر الفقهاء المعاصرون في بيان أصول النظام الاقتصادي الإسلامي؟

Abstract

Some scholars of Islamic economics think that the contemporary Muslim jurists have failed to clarify the foundations of the Islamic economic system and its relationship with the economic reality. By going back to the basis on which these scholars based their argument, it becomes clear that the background of this view is no more than a reflection of the historical circumstances. Therefore, it is necessary to review and renew the foundations of the Islamic economic system in order to widen the scope for the Muslims to meet the terms of every new development. Starting from a model (Zakat/Riba), this paper critizes this methodology and shows that it is possible to build on these two main foundations some other auxiliary and explanatory ones. Thus, the authentic foundations of the contemporary scholars are detailed and based on the authentic foundations of the old ones. يرى بعض الأساتذة في الاقتصاد الإسلامي أن الفقهاء المعاصرين قصروا في بيان أصول النظام الاقتصادي الإسلامي وربطها بالواقع الاقتصادي. وبالرجوع إلى الأصول التي اعتمدها هؤلاء الأساتذة، يتبين أن خلفية هذا الرأي هي أن التأصيل لا يخرج عن كونه مجرد انعكاس للظروف التاريخية التي أحاطت بظهوره، وبالتالي فينبغي في كل عصر تجديد التأصيل وتطويره لتتهيأ للمسلمين أصول واسعة تمكنهم من مسايرة كل جديد. وتنتقد الورقة هذا المنهج وتبين انطلاقا من نموذج تأصيلي (زكاة/ربا) - يرتكز على فريضة الزكاة وتحريم الربا - أنه يمكن أن تُبني على هذين الأصلين الكليين أصول أخرى تابعة لها. وبذلك يظهر أن أصول المتأخرين الصحيحة تبين وتفصل أصول المتقدمين الصحيحة.
