Abstract

The author defines each term in the title of the discussion forum, especially the terms of murābaḥah, ‛inah and tawarruq, both from the Sharīʿah aspect as well as their contemporary applied forms, pointing out their distinguishing features. In this regard he also examines the positions towards those contracts taken by some fiqh academies, the most important among them being the Islamic Fiqh Academy of the Muslim World League. He also sheds light on a new application of murābaḥah contract under a new program adopted by a certain bank. The author presents his important remarks regarding the said program. While publishing this for discussion, the Journal invites its readers to present their views on this topic to enrich the research thinking on the subject. يتناول موضوع الحوار تعريفا لكل من المصطلحات الواردة في العنوان ، وبالتحديد المرابحة والعينة والتورق، سواء من الوجهة الشرعية أم من حيث الصور المعاصرة المطبقة لها، ثم يوضح المقارنة بينها وموقف بعض الجهات الفقهية منها، وأهمها المجمع الفقهي الإسلامي لرابطة العالم الإسلامي ثم يبين تطبيقا جديدا للمرابحة من خلال برنامج جديد للمرابحة طرحه أحد البنوك، ويوضح الباحث أهم ملاحظاته حول هذا البرنامج، والمجلة إذ تقدم هذا الموضوع للحوار تستدعي إسهامات القراء حوله لما فيه من إثراء لفكر البحثي العلمي حول الموضوع.
