Neue europäische Richtlinie zu Mindestlöhnen und Tarifbindung: Ein Beitrag zur sozialen Transformation der EU?

Abstract

Die im November 2022 in Kraft getretene EU-Mindestlohnrichtlinie ist ein Meilenstein auf dem Weg zu einem sozialen Europa. Die Vorgaben zu angemessenen Mindestlöhnen und zur Erhöhung der Tarifbindung in den Nationalstaaten lassen auf einen Paradigmenwechsel in der Konzeption der Union schließen. Der Beitrag zeichnet die Entstehungsgeschichte der Richtlinie nach, informiert über die wesentlichen Regelungsinhalte, prüft ihre Vereinbarkeit mit dem europäischen Primärrecht und ordnet den Rechtsakt politisch ein.
