Abstract

В данной статье анализируется обоснованность регламентации уголовной ответственности за добровольные половые контакты с несовершеннолетними лицами. Автор рассматривает целесообразность нормы ст. 134 УК РФ с точки зрения положений отечественных и международных нормативно-правовых актов, оснований и условий криминализации деяний, структурированности уголовного закона и требований основополагающих уголовно-правовых принципов. Выводы и рекомендации, полученные в ходе исследования, основаны также на материалах судебной практики и статистических данных; также в работе проанализирована позиция законодателя стран СНГ.
