Abstract

В статье рассмотрены перспективы развития медиации в Российской федерации, а также проблемы применения законодательных положений, регулирующих данную процедуру. Актуальность статьи основана на том, что медиация представляет собой относительно новое явление, недостаточно глубоко освещенное в отечественном правоведении, кроме того, нормативная правовая база в отношении медиации достаточно узка. Статья ставит целью определение наиболее эффективных путей развития медиации, ее функции и роли в разрешении правовых конфликтов. В статье также описаны противоречия и недоработки, выявленные в законодательстве, а также разработаны и предложены способы и механизмы их устранения.
