Торгуя Товарами Длительного Пользования: Объектное Множество И Пределы Антитраста

Abstract

Раскрыты основания специфики применения инструментов защиты конкуренции на рынках товаров, харак теризующихся отношениями между основными и производными продуктами. Очерчен круг проблем, связанных с ограничениями конкуренции в контексте соотношения «основной продукт производный продукт» с учетом построения договорных отношений между его производителями (продавцами) и покупателями на основе исследований в области новой институциональной экономической теории. Систематизированы возможные ситуации в аспекте условий сохранения конкуренции на рынках основного и производного продуктов и с учетом существующих норм антимонопольного законодательства. Предложены рекомендации в части применения норм антимонопольного законодательства для ситуаций взаимосвязанных рынков (продуктов) по принципу «основной производный» в российской практике.
