Особенности Административной Ответственности За Нарушение Антимонопольного Законодательства

Abstract

В статье исследуется вопрос об особенностях административной ответственности за нарушения антимонопольного законодательства. Отмечается, что регулирование ответственности за указанные нарушения в Кодексе Российской Федерации об административных правонарушениях имеет ряд существенных отличий от общих правил привлечения к ответственности за все иные административные правонарушения размеры применяемых санкций, срок привлечения к ответственности, правила исчисления штрафов и учета обстоятельств, влияющих на наказание, и иные). В связи с этим делается вывод, что административная ответственность за нарушения антимонопольного законодательства может быть выделена в отдельный подынститут и обособлена от административной ответственности.
