Методические Аспекты Исследования Согласованных Действий

Abstract

С развитием рыночных отношений на товарных рынках, в борьбе за лучшие позиции между хозяйствующими субъектами, нередко наблюдается поведение, поименованное в Федеральном законе от 26.07.2006 № 135-ФЗ «О защите конкуренции» как согласо-ванные действия. При этом указанный Федеральный закон определяет лишь запреты на согласованные действия хозяйствующих субъектов-конкурентов, но не дает ответов на ряд важных вопросов, касающихся как методики исследования согласованных дейст-вий, так и их отличий от параллельного поведения, молчаливого сговора. Данная статья посвящена решению ряда методических вопросов, возникающих в практической работе при исследовании и доказывании наличия согласованных действий.
