Abstract

В статье анализируются нормативно-правовые акты и правоприменительная практика в части пресечения недобросовестной конкуренции с использованием товарных знаков, зарегистрированных в СССР. В настоящее время на рынках стран СНГ активно используется около 1500 товарных зна-ков СССР без четко выработанных правовых регулятивных норм. Авторы отмечают, что вопросы функционирования советских товарных знаков нуждаются в правовой оценке и выработке методов регулирования, не исключающих развития новых маркетинговых технологий, встроенных в механизмы добросовестной конкурентной борьбы.
