Abstract

[eng] Securitization : a global look . This paper studies the development and diversity of securitization in the most developed countries. It is useful to resort to the differences between -on and off -balance sheet securitization operations in order to compare the anglo-saxon countries to Continental Europe. The same split is also relevant when studying the links between counterparty risks and market risks and the issue of the ultimate bearer of the risk. The article also deals with the regulatory dimension of the securitization process, focussing on two aspects : 1) the necessity to adopt a new European directive regarding the securitization process, in order to find a better balance between the logic of competition and the logic of cooperation. . 2) the outlook for securitization in the light of the new Cooke ratio. [fre] Cet article analyse l'essor et les différentes formes du phénomène de titrisation dans les pays développés. La distinction entre titrisation de bilan et titrisation hors bilan sert de fil conducteur pour souligner les convergences mais aussi certaines différences persistantes entre les pays anglo-saxons et les pays d'Europe Continentale. Cette distinction est spécialement éclairante lorsqu'il s'agit d'étudier l'articulation entre risques de signature et risques de marché, et l'identification du porteur final du risque. Elle est complétée par le clivage entre titrisation offensive et défensive. L'article aborde aussi les aspects réglementaires en insistant sur deux aspects : la nécessité de compléter le dispositif mis en place dans le marché unique européen et de trouver ainsi le bon dosage, à propos de la titrisation et des sujets connexes (convergence comptable...), entre la logique de concurrence et la logique de coopération ; l'évolution probable de la titrisation en liaison avec le « reprofilage » en cours du ratio Cooke. .
