Protección de la competencia a través del derecho penal

Abstract

La libertad de competencia es una garantía constitucional de donde se desprende la legitimidad de intervención del derecho penal. Así, la tendencia del nuevo" derecho penal económico está enfocada en sancionar aquellas conductas que atentan contra la economía (libertad de competencia inmersa) y el orden que el mismo Estado ha erigido para permitir su correcto funcionamiento. Mediante este artículo se pretende demostrar la legitimidad del derecho penal para proteger la competencia y ejemplificar algunos eventos en los que concurren las sanciones de tipo administrativo y de tipo penal."
