Giải quyết tranh chấp thỏa thuận cổ đông bằng hòa giải thương mại

Abstract

Hiện nay, nhiều doanh nghiệp còn chưa biết về những lợi ích to lớn khi giải quyết tranh chấp bằng Hòa Giải Thương Mại (HGTM) và pháp luật Việt Nam chưa có quy định về Thỏa Thuận Cổ Đông (TTCĐ). Chính vì vậy, việc phân tích, nghiên cứu để nêu bật các lợi ích khi giải quyết tranh chấp bằng HGTM, làm rõ tính pháp lý của TTCĐ và khi có tranh chấp TTCĐ thì có được đưa ra HGTM để giải quyết hay không là điều cần thiết. Các kết quả nghiên cứu sẽ được chỉ ra qua phương pháp tra cứu, phân tích, diễn dịch, quy nạp. Kết quả nghiên cứu sẽ giúp giảm thiểu rủi ro cho các cổ đông, hoạt động quản trị của công ty.
